Quickly moving through the education committees of the Indiana State Legislature are Senate Bill 167 and House Bill 1040 (now HB 1134), which are a pair of compatible pieces of legislation that, if passed, will radically transform K-12 schools and higher education’s role in educator preparation. They have catastrophic implications for preparing teachers to impart racial equity, promote classrooms that are warmly inclusive and multicultural, and exemplify socially just education.
Contrary to Indiana’s social studies standards that foreground civic education, SB 167 introduces job training skills as the purview of this interdisciplinary area intended to prepare students to be informed citizens in a democratic society. They propose ideological intrusions in education (e.g., preventing critically conscious examination of multiple political regimes) in ways that are akin to censorship and that run afoul of free speech rights in an academic setting. In higher education, these intrusions threaten the cultivation of the communication skills that the National Association of College and Employers (NACE) standards dictate.

These proposed reforms relate not only to Teachers College but also to all the subject areas of teacher licensing, which include, for example, the College of Sciences and the Humanities, the College of Communication, Information and Media, and the College of Music.

We request that both the Teachers College and Ball State University’s leadership publicly reaffirm their commitment to culturally relevant pedagogy and inclusive excellence in its educator preparation program by weighing in on this legislation. Indeed it is a travesty that EPP programs across the state have remained silent, thus far.
Below are the grounds for our opposition to both bills. They:
I. Categorize identity talk as divisive in K-12 and higher education
The bills offer eight precepts to influence K-12 curricula and pedagogy and the higher education educator preparation programs (EPP). As constructed, teachers are prohibited from engaging in curricula and instructional strategies that exhibit any of these eight characteristics or “divisive concepts.” EPPs must similarly restructure their curricula to comply. We argue that the Indiana Academic Standards, as written, and for which we prepare teacher candidates, provide curricula that are proven to not exhibit these attributes in relation to civic norms for education such as anti-racism, respect for differences, and critical democratic thinking. In addition, these eight precepts, as written, hold the possibility of catastrophic unintended consequences such as undermining the tenuous relationship between learners and teachers and introducing the threat of lawsuit into teachers’ already onerous burden in teaching multiple subjects.
They are also inconsistent, on their face, with students achieving cultural competency in the pluralistic social context of the United States. As Banaji & Greenwald (2013) maintain, appreciating the blind spots that originate in our historical, social, and cultural context is essential to acquiring the knowledge, skills, and abilities to cultivate equitable classrooms. This cultural competence in conjunction with critical and analytical skills are ones that future employers value, according to NACE’s Career-Ready standards for critical thinking. How are future teachers to cultivate these skills in a learning environment that suppresses critical reflection?
II. Frame learner affect as trigger for teacher non-compliance
Another reason to oppose these bills is that students’ emotions (e.g., distress, unhappiness and grievance), the learner affect, are to be the trigger for teachers not complying, even if they did not intend to carry out concepts one through seven. There is no specification of the grade-level. Because these stipulations apply for grades K-12, the precepts do not take into consideration developmentally relevant considerations. Learning theory and educational philosophy maintain that these affects can be attributes of effective instructional strategies in many disciplines, (e.g., English language instruction, second language learning, and humanities) classes at any time. That a student feels this way is in no way a gauge of the teacher’s intention and could be part of the pedagogical trajectory, as students can experiences these feelings temporarily.

Current Indiana academic standards and the district adoption of syllabi undergo thorough examination, by researchers, academics and practitioners to ensure that they are proven to be developmentally appropriate, offer rigorous coverage of the disciplines, and convey civic capability that a democratic society requires. They reflect evidence-based and principled curricula rooted in preparing students to be contributing citizens. Shouldn’t education policy come from evidence-based deliberation?
